Legal Counsel
Matters.

Buying property in Portugal involves legal documents, property records and contractual commitments that should be properly understood before you proceed. Having appropriate legal support gives you someone focused on the legal aspects of the purchase and helps ensure that the property and the terms of the transaction are properly reviewed.

Before you commit

Once you’ve identified a property you would like to pursue, the appropriate legal checks can be carried out before you make contractual commitments.

The purpose is to understand the legal position of the property, identify anything requiring clarification and make sure you know what you are agreeing to before proceeding.

Checking the property

Your legal team can review the relevant property records and documentation, including ownership, registrations and any charges or other matters affecting the property.

The precise checks required will depend on the property and the circumstances of the transaction.

Reviewing the CPCV

The CPCV is an important contractual stage of the purchase and should be reviewed carefully before it is signed.

Your lawyer can check that the agreed purchase price, deposit, completion arrangements and other conditions are properly reflected in the contract, and explain the legal implications to you before you commit.

Preparing for completion

Legal support continues through to completion, helping ensure that the necessary documentation and requirements are in place for the final deed.

Depending on the purchase, your lawyer can also represent you through an appropriate power of attorney if this is required and suitable for your circumstances.

Your own lawyer or our legal team

Buyers are free to appoint their own lawyer, and many international buyers prefer to have independent legal representation throughout the purchase.

The Agency Portugal also has an experienced legal team that can guide and support the process. If you appoint your own lawyer, our team can work alongside them where appropriate.

I’m not providing the legal advice myself. My role is to help keep the property transaction coordinated, make sure the right people are involved at the right stages and help you understand how each part of the buying process fits together.

That allows the legal professionals to handle the legal work while I remain focused on you, the property and the wider transaction.
